Postawienie takich pytań wydaje się zasadne z co najmniej kilku powodów. Dekodyfikacja zdaje się być obecnie relatywnie "nową" cechą wyróżniającą prawa prywatnego tradycji kontynentalnej2 - od niemal czterech dekad jest szeroko dyskutowana. Nie ustają również wynikające z tej dyskusji spory o znaczenie kodyfikacji w systemie prawa. Za rolę nauk prawnych można zaś uznać przede wszystkim opisywanie normatywnej i około normatywnej rzeczywistości, dlatego też szersze odniesienie się do symptomów dekodyfikacji występujących na polskim gruncie wydaje się nieodzowne i stanowić powinno przy tej okazji wypełnienie pewnej istotnej luki w dotychczasowej literaturze prawniczej. W drugiej kolejności warto zaś wskazać, że wśród skutków postępującej dekodyfikacji prawa cywilnego wymienia się wzrost roli przeróżnych sposobów tworzenia norm, które w idealnym świecie oświeceniowego kodeksu cywilnego oraz pozytywizmu prawniczego w ogólności zdawały się być skazane na zapomnienie.</p> <p> </p>
