Le présent ouvrage propose une réflexion sur le rapport entre objectifs et compétences dans l’Union européenne en tant que corollaire du principe d’attribution et sous l’angle de l’autonomisation des objectifs. <br> <br>Dans une première partie, les auteurs abordent les objectifs assignés à l’Union européenne comme pierre angulaire de la répartition verticale et horizontale des compétences. D’un point de vue vertical, les objectifs constituent la référence pour l’exercice des compétences attribuées et ne sauraient être interprétés au-delà de celles-ci. D’un point de vue horizontal, les compétences ne sauraient être conçues indépendamment des objectifs au profit desquels elles ont été attribuées, au risque d’enfreindre le principe de spécialité. Cependant, le rapport entre objectifs et compétences ne se limite pas au parallélisme. <br> <br>Dans une deuxième partie, les auteurs abordent les objectifs au-delà des compétences. Les objectifs généraux qui ne correspondent pas à des compétences spécifiques peuvent être identifiés explicitement dans les traités ou résulter de la jurisprudence comme inhérents à l’objectif final d’intégration. De tels objectifs interviennent dans le champ des compétences et objectifs sectoriels, en tant qu’axe de développement des principes régulateurs de l’exercice des compétences. Le dépassement du rapport objectif-compétence est à constater également au sein des objectifs précis, objectifs-valeurs ou objectifs qui régulent l’exercice des compétences autres que celles qui auraient pu leur correspondre. La dynamique des objectifs, inhérente à une interprétation finaliste, structure ainsi l’ordre juridique de l’Union européenne et confirme son autonomie.
